Terms of use.

The rules under which we publish pershorenashdomandelmoretrust.org, accept donations, and make our publications available — written in plain English, and short enough to read in ten minutes.

1. Who these terms are between

These terms are an agreement between you (the visitor, donor, oblate, retreatant, applicant or correspondent — referred to in this document as "you") and The Pershore Nashdom and Elmore Trust ("the Trust", "we", "us", "our"). The Trust is a registered charity in England and Wales (charity number 220012), incorporated by Memorandum and Articles of Association dated 13 November 1937, with its registered address at Sarum College, 19 The Close, Salisbury, Wiltshire SP1 2EE. By using this website, by making a donation to the Trust, or by entering into any other relationship with us, you agree to these terms.

2. The website

The Trust publishes pershorenashdomandelmoretrust.org as a public service, free of charge, on a "reasonable endeavours" basis. We make no warranty that the site will be available at any particular time, free from error, or compatible with any particular device. We will, however, make reasonable efforts to correct any error of which we are notified, and we maintain a small log of significant outages in the office. If the site is unavailable when you need it, please write to the office instead.

3. Accuracy of content

We take pains to make the content of this site accurate at the date of publication. The site is, however, a general guide and not a substitute for professional advice. In particular:

  • The information on Gift Aid is general; please consult HMRC or your accountant for advice on your own tax position.
  • The information on bequests is general; please consult a solicitor when drafting or amending your will.
  • The information on grants is a summary; the binding terms are those in our written guidelines and decision letter.
  • The dates of events are accurate at publication, but may change; please confirm with the office before travelling.

If you spot an error — even a small one — please write to [email protected] and we will correct it gratefully.

4. Permitted use

You may, without our specific permission:

  • Read, print and download any page of this site for your personal, non-commercial use.
  • Link to any page of this site from your own website, blog or social media account, provided the link clearly identifies the source.
  • Quote a short extract (up to 250 words) of any of our published text, provided you attribute the quotation to the Trust and provide the original URL.
  • Reproduce, in whole or in part, our annual reports and other publications expressly marked as available for free distribution, provided they are reproduced unaltered and with attribution.

You may not, without our specific written permission:

  • Use any of our images, brand marks or logo in any context, commercial or otherwise.
  • Reproduce any substantial portion of our text in a commercial publication.
  • Imply, by your use of our material, that we have endorsed your project, organisation or views.
  • Use any automated means (scrapers, bots, crawlers other than those of bona fide search engines) to harvest content from this site.
  • Frame, iframe or otherwise embed substantial parts of this site within another site.

5. Intellectual property

All text, photographs, illustrations, designs and computer code on this site are the intellectual property of the Trust unless otherwise marked. Where third-party material appears — typically a quotation, a poem, or a photograph credited to a named photographer — it is used either with permission or under fair-dealing provisions of UK copyright law. If you believe any material on this site has been used without proper authorisation, please write to the office; we will investigate and, if appropriate, remove or attribute the material within fourteen days.

The Trust's name and the words "Pershore Nashdom and Elmore" used in conjunction with a charity, monastic or religious body are reserved for our use. You may not register a company or charity that adopts these words in a manner liable to cause public confusion.

6. Donations

Donations to the Trust, however made, are accepted on the following basis:

  • You confirm that the gift is your own money to give — that is, you have not taken it from any other person or organisation in breach of your duties to them.
  • You agree that the Trust may apply your gift to its general charitable purposes, except where you have, in writing, restricted your gift to a particular fund (for example, the Pershore Hospitality Fellowship). We will respect a written restriction, provided the restricted purpose is consonant with our charitable objects.
  • You may cancel a donation and request a full refund within fourteen days of the date you made it, by writing to the Bursar at [email protected]. After fourteen days, we will consider a refund only where there has been an honest mistake — for instance, an accidental double payment, or a gift made under a clear misunderstanding.
  • If you have signed a Gift Aid declaration and you cease to be a UK taxpayer, please tell us; we will note this on our records and refrain from claiming Gift Aid on subsequent gifts.
  • The Trust complies with the Fundraising Regulator's Code of Fundraising Practice and is a voluntary signatory of the Fundraising Promise.

7. Retreats, oblation and grant applications

The specific terms of a retreat booking, an oblate postulancy or a grant application are set out in the relevant correspondence and, where appropriate, in our separate written guidelines (available on the Resources page). Those terms, when entered into, prevail over these general terms in any matter of detail.

8. Third-party links

This site contains links to other organisations' websites — for example, to Sarum College, Salisbury Cathedral, St Gregory's Abbey in Three Rivers, Michigan, the Charity Commission, and the Information Commissioner's Office. We provide these links for your convenience and we are not responsible for the content, practice or availability of any linked site. A link does not constitute an endorsement of any organisation, product or service.

9. Limitation of liability

Nothing in these terms limits or excludes any liability that, by law, cannot be limited or excluded — including liability for personal injury or death caused by our negligence, or for fraud or fraudulent misrepresentation. Subject to that, we accept no liability for any indirect, consequential or economic loss arising from your use of this site or from any reliance you place on its content. If you require a binding statement of our position on any particular matter, please write to the office.

10. Changes to these terms

We review these terms each May. We may, from time to time, make small clarifying changes; we will not make substantive changes without a written explanation. The date at the top of this page indicates when the current version came into effect. Significant changes will be flagged on the home page for at least four weeks before they take effect.

11. Governing law

These terms, and any non-contractual obligation arising from them, are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising from these terms or from your use of this site, save that nothing in this clause prevents us from bringing proceedings, where necessary, in another jurisdiction in which assets of a person liable to us are situated.
